Post subject:  Carry on 'border waters'?

didn't come up with any results using the 'search feature'. :?

While I'm not really one to fish or go boating, it has been known to happen (maybe twice in the past 10 years). My brother is interested in getting his P2C and is an avid fisherman on the river.

Anyways, we have a family cabin on the Mississippi near Wabasha. IF I (or my brother once he gets his P2C and starts carrying), decide to go out in a boat or go ice fishing, can I (we), legally carry while out on the Mississippi?

What's the law/guidance on this?

My take right or wrong, is that there is an imaginary boundry line running down the river that determines what state you are in, I think you could be in "wi" while fishing the river. The basic rule when fishing the river fishing license wise is you can fish to the up to the wi railroad tracks with your mn license, but I don't think this will help you in a carry situation. I disarm and lock my gun or leave it at home when fishing the mississippi border water.


I've thought about it this is what I've decided, by no other means than talking "with myself" .

It would probably be wise to call the local sheriff, PD, and DNR. Ask to speak to the highest ranking officer and make them commit to the answer by giving a name and badge number.

Nope. That provides no legal protection, and cops are FAR from the people to consult on esoteric areas of law. Brian Toder, of Chestnut and Cambronne, on the other hand, is a pro-gun attorney, a carry instructor, and a noted expert on maritime law. He might know. :)

That's absolutely true. Cops are not your pals when determining the law (unless of course they are, in fact, your pals, and even then they might just not know).

Still, it couldn't hurt to ask anyway. Just make sure to leave the P2C context out of the discussion. That always puts them in the mood to dissuade. If you just ask an upper DNR official where Wisconsin begins in their policy, they'll probably tell you.

Not to belabor this point, however, I think it has been firmly established in previous discussions and encounters that the Police, DNR low levels, and Sheriff's do not know the law and even if they did, would simply give you their version, not what a judge or DA would think. That is why, and I mean no disrespect to anyone, time and again, the point is made to call an atty for their views and opinion. Cops are not your friend. I would hate to see anyone call the police for an opinion and then suffer due to bad info.

Look, you can badmouth the cops in general all you want about them / us not knowing the law.

If it was so fucking simple, then why the hell are there so many attorneys?

Sorry if you feel I was badmouthing police in general or you specifically. I was not. My point is that asking an individual officer a question regarding the law and then basing your actions on that information is, at best, a dicey proposition. I get my law advice from an atty.

We have documented cases showing what can happen even asking the head of state departments and even they do not know for sure all the time. Hence, why risk serious problems because you asked someone whose job is not specifically to parse the finer points of law?

Again, I apologize if my comment came across as cop-bashing. That was not my intent.

I didn't take it personally. :D

I was just trying to make the point that you just reiterated. I know a lot of laws and how they are generally applied. At least enought to get YOU into trouble.. :shock: If I need a real legal opinion, I ask a real lawyer.
