20-year-old man sentenced for Nov. 2008 accidental shooting of Fridley High School student

A 20-year-old man was sentenced Tuesday, July 21, for the Nov. 14, 2008, fatal shooting of an 18-year-old student at Fridley High School. The shooting was initially identified as an accident.

Samuel Kelich Dennis was sentenced on 2nd-degree manslaughter to four years' stayed prison time, which means that he is on probation for 10 years, Assistant Anoka County Attorney Wade Kish explained. Dennis will serve one year of local jail time at the Anoka County Jail, Kish said.

Dennis was taken into custody yesterday to begin serving his time. His release date is set for February 9, 2010, because he already served some jail time when he was arrested after the incident last fall and, with good behavior, he would only have to complete eight months of jail time.

Additionally, Dennis will have to contribute 20 hours of community service every year near the date of the incident, Nov. 14, and pay restitution of $6,500 for the victim's funeral expenses.

Kish gave this account of the incident:

Police were called to a shooting Friday night, Nov. 14, where they found Dennis giving resuscitation efforts to Emmanuel Bartouh. Dennis told police that he had been showing to his friend a gun that he thought was unloaded. Dennis pointed the gun at Bartouh's chest and pulled the trigger, accidentally killing his friend.

Dennis pleaded guilty to 2nd degree manslaughter, which is when negligence causes the death of another person.

Fridley High School Principal Dave Webb remembered Bartouh as a good student and athlete after the accident.

"He was a good role model," Webb told Sun Focus Nov. 18, 2008. "He did set an example for others to live up to."

The Question I have is wouldn't it be illegal under federal law for a 20 year old to purchase a handgun since the law say you need to be 21 to purchase a handgun from a licensced dealer. Or did he get around that by buying from a private party or was it a stolen gun. The article never talked about how the handgun was obtained. by the way IANWAL. Just looking for clarification on how he would have obtain the gun. if the gun was obtained illegally why didn't they add charges for that.
